Woman charged with DWI while picking up man -- who had earlier been charged with DWI

BATAVIA -- New York State Police had a two-for-one DWI sale on Monday.

It started when Troopers charged Jay Markle with DWI following a traffic stop on SR-33 in Bergen. Markle was placed under arrest for DWI after failing field sobriety tests.  He was processed at SP Batavia where he provided a breath sample of .12 percent BAC.  He was released on tickets returnable to the Town of Bergen Court. 

Markle called Darlene Martaus to come pick him up at the barracks. When Martaus arrived at SP Batavia, Troopers could detect the odor of alcoholic beverage and had Martaus perform field sobriety tests. Martaus was subsequently arrested for felony DWI, aggravated unlicensed operation, operating a vehicle without an interlock device, and other vehicle and traffic charges. She provided a breath sample of .12 percent BAC.  Martaus was arraigned and remanded to the Genesee County Jail.
